I. GENERAL TERMS AND CONDITIONS OF CLASSES
LESSON PLANNING
The schedule for the latest series of lessons is published on the Sukoon Studio website.
MISSED CLASSES
Missed lessons cannot be made up or refunded.
CANCELLATION OF CLASSES
Lessons can be canceled up to 10 days before the start of the lesson series / workshop. A cancellation fee of €35 will be charged here. The remaining amount will be refunded.
Cancellations will no longer be accepted within 10 days of the lesson series / workshop.
PARTICIPATION IN THE CLASSES
Sukoon Studio wants to provide quality and consistency during classes. The lessons are personal and cannot be transferred to another person after the first lesson. If someone else would prefer to follow the series of lessons, you can inform us in advance by telephone or e-mail with all the necessary details of the new participant.
GENERAL
MENTALITY IN THE STUDIOSukoon Studio is a shared studio. This means that members are dependent on each other and the shared space. Members can help other members and their behavior is crucial in the community.
At the same time, members must also take care of their own materials and work.
Members may use the tools of the studio, but we recommend that you bring your own materials, aprons and towels.
We have to work together to keep the studio running properly. Remember that when you are a member of Sukoon Studio, this is your workplace, so take care of it.
OPENING HOURS
Sukoon Studio is open on Tuesday, Wednesday, Thursday, Friday, Saturday and Sunday. The correct opening hours can always be found on the website.
CLOSED DAYS
Sukoon Studio has the right to change the opening hours. These changes will be communicated in a newsletter and on the website.
There may be a few days a year when the studio will be completely or half closed due to planned workshops or events. We will communicate as quickly as possible these days. No refunds of money or time apply for this.
AGE
Sukoon Studio is an open studio where makers can work independently with minimal guidance. Our membership is not accessible to under 18s.
SHARED SPACES
Personal belongings are brought to the studio at your own risk and Sukoon Studio accepts no liability for loss or damage to such items. In a communal studio it is inevitable that work will sometimes be damaged.
BISQUE FIRE AND GLAZE FIRE
At Sukoon Studio, only pieces that were made in the studio itself are fired. Works from home or another studios cannot be fired in Sukoon Studio.
GLAZES
Only pieces that were also made at Sukoon Studio can be glazed. Membership includes the 'fair use' of glazes provided in Sukoon Studio. Outside glazes cannot be used unless permitted by Sukoon Studio's manager or owner.
Students are responsible for irresponsible behavior when applying glazes. Our operations staff will not fire the pieces if it is deemed that the glaze was applied far too thickly or the bottom of the works was not properly cleaned.
Students and members must especially ensure that the glaze does not melt on the kiln shelves during baking. The glazes cause damage to the oven plates that cannot be repaired. We will charge members and students the full amount for the oven plate to be replaced, which can amount to €60 per shelf.
CLEANING UP
Everyone is responsible for ensuring that the studio remains a pleasant workplace. Once you have used the studio, allow at least 20 minutes to clean your workplace and communal areas. Cleaning a wheels can take longer. Clay dust is dangerous and can cause silicosis, so clean it every time it is wet.
Make sure you leave the room clean when you leave the studio.
LIABILITY
Sukoon Studio cannot be held responsible for certain classes, instructors and/or equipment being unavailable for any reason.
The Company reserves the right, in its sole discretion and without notice, to make changes to the timing, structure and content of any class and the identity of any teacher and/or equipment availability. The Company will not be liable for any damages caused by any such changes except to the extent that such loss is not legally capable of being excluded.
Personal belongings are brought to the studio at your own risk and the company accepts no liability for loss or damage to such items.
The Company accepts no liability for any loss or damage suffered by a Member on the Studio premises or outside the Studio, except to the extent that such loss, damage or injury cannot be excluded by law.
PRIVACY
Sukoon Studio stores your contact details to keep you informed of the latest news. Members and students can be contacted by telephone or email for last-minute changes and for catch-up lessons. New information for the members of the open studio will also be sent by email. Sukoon Studio strives to keep personal data safe and does not share this data with third parties.
II. GENERAL CONDITIONS OF OPEN ATELIER
What are these general terms and conditions?
These General Terms and Conditions apply to the Services provided by Sukoon Studio, in particular to the persons who become Members of the Open Atelier.
These terms and conditions apply to all Members of the Studio and to all applications for membership of the Studio.
The following definitions apply in the General Terms and Conditions:
“Course” means any organized and supervised session for members for which an additional fee may be charged;
'Student' refers to any Member who pays for a course;
“Company” means Sukoon Studio;
'Member' means any person who has completed and submitted an application for Membership via the (online) registration form, either via the website or in person and whose Membership to the studio which carries the benefits and obligation set out in these Terms ;
'Term' means the contractually agreed period to which the Member and Sukoon Studio are bound
'Notice Period' means the notice period set out in the terms and conditions relevant to the contract option chosen by the Member. The standard notice period (if no term is stated) is 1 calendar month which expires no earlier than the end of the Term;
“Registration Form” means the online or paper form to be completed by an individual wishing to become a Member of the Studio;
'Guest' is a third party (visitor) who enters the building and uses the location;
“Services” means all services provided by the Company in the Studio to Members as part of their membership;
'Session' means any period during which the Member has booked to use the facilities offered by the Studio;
'Studio' means the studio of Sukoon Studio located at Oudeleeuwenrui 34a, 2000 Antwerp.
“Terms” means these terms and conditions.
'Week' means the period from 00:01 on a Monday morning to 23:59 on the following Sunday evening.
The Company may change these Terms and Conditions at any time. We will notify you of any changes to these Terms and Conditions by sending you an email and/or by posting a notice in the Studio. By continuing to use the Services after changes to these Terms have been made and communicated to you, you agree to be bound by such changes.
You can view the most recent version of our Terms and Conditions at any time by clicking on the Terms and Conditions link at the bottom of the Website. It is your responsibility to ensure that you are aware of the current Terms and Conditions. You are advised to check the above link regularly.
1. Membership
1.1. A person will only become a Member of the Studio once he has completed the Registration Form and his application for Membership has been accepted in writing by the Company. At that time, the Member is deemed to irrevocably agree to these Terms and Conditions.
1.2. If a Member brings a Guest to the Studio for a Session or Workshop, that Guest must have taken note of these Terms and Conditions before the start of the relevant Session or Workshop.
1.3. Payments for Memberships and workshops are non-refundable unless otherwise stated in these Terms.
1.4. A Member who purchases Open Atelier time through a subscription is entitled to use the Studio up to 15 hours per week. Weekly hours cannot be transferred. The total number of hours can be changed unilaterally by Sukoon Studio.
1.5. In the event that a Member wishes to make use of additional Open Studio hours during a certain week, he must agree this in advance with the management of the Studio and purchase these additional Open Studio hours in blocks of 5 hours. Each hour will be charged at 33.5% of the standard contract rate applicable to the relevant Member.
1.6. The provision of additional Open Studio time in accordance with 1.5 depends on the availability of the Studio space as well as the accessibility of the Studio management. No member may use additional Open Atelier for more than 15 hours in a six-month period.
1.7. After an initial 1 month commitment, an Open Atelier Member may, subject to Company approval, suspend their membership for a period of two months (but not less) in any 12 month period. An administration fee of €20 per month is payable in the form of a reduced monthly fee or as otherwise specified by the Company for the period of suspension.
1.8. Membership fees must be paid in accordance with these Terms and Conditions whether or not the Member uses the facilities of the Studio.
1.9. Membership fees can be increased unilaterally by Sukoon Studio. Members will be notified at least 10 working days in advance of any increase in membership fees.
1.10. A Member may not attend any Course or Session at the Studio without first booking and paying for the relevant Course or Session.
1.11. To reserve a Course or Session, payment must be received no later than 14 days before the scheduled start date or (if booked earlier, at the time of booking). Cancellations must be made in accordance with the cancellation policy below.
1.12. Payments for Sessions and gift vouchers in any form are non-refundable, unless otherwise stated in the Terms and Conditions. If a package is purchased and only a portion is used, there will be no refunds for the remaining Sessions.
1.13. The prices of the Open Studio and Courses are available on the Website or directly from the Studio and are determined by the Company from time to time.
2. Payment terms
2.1. Subject to any right of the Company to cancel or suspend the Membership, the Membership will continue indefinitely unless and until a Member terminates his Membership by written request to the Company with clear notice of the desired cancellation date. A date that may not be earlier than the end of the contractually agreed Term. No refunds will be made to a Member in respect of Membership fees already paid.
2.2. If a Member does not pay his membership fees for the Term (or cancels his Membership during the Term), the Member will remain liable for the difference between the current monthly rate on the date of cancellation and the price paid by him under his subscription.
2.3. Any Member who does not wish to accept any change to the Membership Fee proposed by the Company may cancel his Membership by notifying the Company in accordance with condition 8. The giving notice must continue to pay his Membership Fees at the rate applicable immediately prior to any proposed increase until the end of such notice period (or in the case of a Member whose Term has not expired until the end of such period).
2.4. The Membership is not transferable after the start of the contract and cannot be shared.
2.5. The Open Atelier members have a fixed kiln baking quantity of 40 liters per month that is included in their monthly contribution, as well as access to the studio glazes. Participants in the Courses pay a material fee based on the baked weight. The current rates and fees are listed on the website.
3. Studio opening hours
3.1. The company reserves the right to change opening hours. The opening hours will be stated on the website.
3.2. The studio is closed 1 month per year during the summer period. The Company reserves the right to close the Studio for additional periods at its sole discretion.
4. Bookings and cancellations of Sessions and Courses
4.1. A Member can only book or move a Session or Course for themselves via the booking software on the Website.
4.2. The cost of a Session or Course (as applicable) will be charged to the Member if the cancellation or rescheduling of a Session or Course has not been made online or if a Studio employee has not notified the Studio personally. The cancellation or relocation must be done at least 7 days before the booked time.
4.3. Sessions and Courses are booked on a first come, first serve basis. A Member can use the waiting list facility on the website in the event that their first choice for a Lesson or Course is not available.
4.4. The Company is not responsible for the unavailability of a particular Course, instructor and/or material for any reason. The company reserves the right to make changes to the timing, structure and content of the Course, the identity of the instructor and/or the availability of equipment, and/or the availability of the Course at its sole discretion and without prior notice of the nature of the additional facilities offered to Members. The Company is not liable for damages resulting from such changes, except to the extent that the damages cannot be excluded by law.
5. Health and safety
5.1. Members use the Studio at their own risk and are aware of the inherent hazards of a studio environment, including the use of sharp tools and sharp edges, exposure to toxic materials, the dangers of using materials and equipment at high temperatures and the risks associated with inhaling clay dust.
5.2. Each Studio Member is required to read and follow the health and safety information in the handbook and undergo a health and safety briefing before commencing their membership. Each Member expressly acknowledges that he agrees with the content of the information.
5.3. Each Member must at all times comply with all health and safety instructions given by Company personnel.
5.4. Each Member is required to keep all surfaces clean of clay and glaze and to thoroughly clean all areas, including the floor around their work station, before completing their Session. This is to minimize the risks to members from inhaling clay and glaze dust.
5.5. In the interest of safety and hygiene, it is not permitted to use crockery, glass or food in the studio. Pets are not allowed in the buildings or on the grounds of the Studio.
5.6. Members must use the main entrance of the Studio when entering or leaving the Studio. Fire exits that are clearly marked are in the interest of safety and members must not disturb these exits for any reason. In the event of fire, members are asked to proceed to the nearest available exit.
5.7. Smoking is prohibited in the Studio.
6. Use of facilities
6.1. A member is entitled to use the facilities of the Studio during opening hours and subject to these Terms, except that the Company may at any time without notice withdraw its facilities in whole or in part for a period or periods in connection with cleaning, repair, modification or maintenance work for or for any other reason.
6.2. Children under the age of 16 may only use the Studio and attend classes if accompanied by an adult (who must be a Member). Members under the age of 18 must have written permission from a parent or guardian.
6.3. Open Atelier membership includes “fair use” of the glazes supplied by the Studio for use on pieces created only at the Studio. External glazes or homemade glazes may not be used in the Studio unless with prior written permission. To obtain permission, the glaze must be test fired in collaboration with the company's technical director to ensure no damage is caused to the kilns or other members' kiln materials or work.
6.4. The Open Atelier membership includes 40 liters (40 cm2) kiln capacity per month in the communal boiler room, loaded by the studio manager at the Studio's preset temperatures. Only pieces created in the Studio may be fired under this allowance. This allowance cannot be carried over to the following month. Any additional creations can be baked at a cost of €4/kg, this price only applies to members of the Open Atelier. This price is subject to change to reflect the actual costs of heating.
6.5. All glazed pieces must be fired on a dedicated kiln tray protected with batt wash. This is to prevent damage to the oven plates due to dripping glazes. Members are liable for any damage to the ovens or oven plates caused by irresponsibly applied glazes. Studio managers will not fire objects where the glaze has been applied too thickly or where the base has not been cleared of glaze.
7. Cleaning
7.1. All members are required to clean the Studio (both work area and floor) at the end of each Session. If the area has not been properly cleared and cleaned, Sukoon Studio may charge an additional fee of 30% of its membership fee to cover staff cleaning time.
7.2. Each Member is required to use the Studio's bucket system when cleaning. This is for cleaning all clay and glaze equipment, as well as washing hands.
7.3. The Studio sink may not be used to clean clay, glaze or other materials from equipment or hands. These should only be used to collect water for hygiene purposes. Clay, glaze and plaster may not be thrown away in the sinks or drains, neither in the studio nor in the outdoor area. All members must use the available rinse buckets.
7.4. The kitchen sink should not be used at any time for cleaning clay and glaze materials or equipment.
8. Termination of Membership
8.1. A Member may cancel Membership within 14 days of acceptance of Membership by the Company, provided that Member has not used the Studio and/or attended any Session or Course during such period. In order to cancel a Membership under this condition, the Member must notify the Studio of the cancellation in writing, either by email or by letter delivered to a Studio employee.
8.2. A Member who purchases Open Atelier time through a regular payment agrees that he cannot cancel his Membership before the expiration of the minimum Term of 2 months from the date of his first payment for a 2 month contract, 6 months before a 6 month contract and 12 months for an annual contract.
8.3. A Member may terminate his Membership by giving written notice to the Studio of at least the 30 days notice period expiring before the end of the Membership Term.
8.4. The Company reserves the right to expel any Member from the Studio (and terminate their Membership in the Studio), suspend their Membership for a period of time or refuse to renew a Member's Membership; whose conduct is or, in the reasonable opinion of the Company, may be harmful to the character of the Studio; or which breaches any of these Terms (as may be amended from time to time); or where it would be in the interests of the other Members of the Studio. Any Member expelled for breach of these Terms will immediately cease to be a Member of the Studio and will not be entitled to any refund for any periods already paid for. A Member whose Membership has been suspended will not be entitled to any refund for that period. Notwithstanding the foregoing, the Studio may terminate the Membership of a Member if such Member has not paid any amount due to the Studio within 14 days of the date on which such amount is due. In the event of termination due to non-payment, the balance of fees owed for the remaining term of the Membership will become immediately due and payable. Termination of these terms and conditions shall not affect the rights and obligations of the Studio and the Member arising and accruing prior to the date of termination.
9. Limitation of Liability
9.1. The Company is not liable for any direct or indirect damage caused by the activities of one of the members or the way in which a member carries out his activities, without being exhaustive: by a use contrary to good morals or with applicable regulations, any criminal or fraudulent actions, infringements of intellectual property rights, etc.
9.2. The Member is responsible for his property or the goods entrusted to the Member by third parties. Accordingly, The Company is not responsible for any damage to goods or by goods, loss or theft of the Member's goods. Any efforts made by the Company to secure the premises or facilities provided by the Company for the storage of goods shall not imply that the Company shall have any liability in this regard.
9.3. The Member is responsible for his Guests, third parties (visitors) who enter the building and use the location. The Member undertakes to register and correctly identify each person. The Company is not liable for any damage caused by any breach of this provision.
9.4. If there is an interruption of the functions, infrastructure, machines, utilities, internet connection, the Member cannot claim compensation for any direct or indirect damage from the Company.
9.5. The Member expressly understands and accepts that the Company uses third parties, subcontractors or preferred partners, to provide services to the Members (for example, without being exhaustive, cleaning services, maintenance services, etc.). The Company is not liable for any inadequate service provided by subcontractors or preferred partners.
9.6. All work or services performed for the Member through the intermediary of The Company or its appointees fall outside the responsibility or liability of the Company. No compensation can be claimed from the Company due to the temporary failure of these services and/or activities.
9.7. The Company will not under any circumstances be liable to any Member, whether in contract, tort (including negligence), breach of statutory duty or otherwise, for any loss of profits, or any indirect or consequential loss or damage arising out of or in connection with his Membership and/or these General Terms and Conditions; and the entire liability of the Company to the Member in respect of all other damages arising out of or in connection with his Membership and/or these Terms and, whether in contract, tort (including negligence), breach of statutory duty, otherwise, will in no event exceed the amount of fees paid by the Member during the Initial Term or Renewal Term (as applicable) in which the damage occurred.
9.8. The Company will not be responsible or liable for any delay or failure to conduct any Sessions or Courses (i.e. the performance of this Agreement), if such delay or failure is due to any cause beyond our reasonable control, such as, but not limited to, strikes, labor shortages, fires, floods, epidemics, forces of nature, acts of war, storms, earthquakes, explosions, accidents, material, fuel, transportation shortages, and delays or defaults caused by public carriers that cannot reasonably be predicted or provided for, embargoes, government regulations or order, dangers to navigation, acts of public enemies, mafias or rioters and acts of force majeure. If any such event, which is beyond our reasonable control, occurs, all Sessions and Workshops are strictly non-refundable and non-exchangeable notwithstanding our standard terms and conditions and refund policy.
9.9. Personal property is brought to the Studio at your own risk and the Company accepts no liability for any loss or damage to such property.
9.10. The Company accepts no liability for any damage suffered by a Member on the grounds of the Studio or outside the Studio, except to the extent that such damage or injury cannot be excluded by law.
9.11. Each Member insures himself against personal accidents. For accidents not covered by the Policy or higher amounts than those provided for in the coverage, it is expressly agreed that the Studio itself cannot be held liable for this, except for its intent, gross negligence or that of its employees or agents.
9.12. Neither the Studio nor its employees can be held responsible for the death, personal injury or illness of members, their children and Guests performing on the Studio premises.
9.13. This Terms shall survive any termination of these Terms.
10.Privacy
10.1. Data processing of Sukoon Studio acts in accordance with the provisions of the law on the protection of privacy of December 8, 1992 with regard to the processing of your data. Your personal data will be included in our member database and processed for the following purposes: to manage the customer base and the products and services offered, to conduct market studies, to inform you about new products and services and for promotional campaigns. This personal data may also be used by the Studio for direct marketing purposes and may be communicated to third parties for these purposes. You have the right, upon request and free of charge, to object to the intended processing of your personal data for the purpose of direct marketing. If the member does not wish his data to be used in this sense, he can let us know at the following address: hello@sukoon.studio.
11. General
11.1. Each Member represents and warrants to the Company that all information provided by it is complete and accurate as of the date it is provided to the Company. Each Member is required to notify the Company of any change in home address or email address. In the absence of such notice, all notices will be deemed to have been received by Member within five days of dispatch to the last address communicated to the Company.
11.2. The Company reserves the right to refuse access to the Studio.
11.3. The Company may transfer the benefit of these Terms and Conditions and the Membership to any third party at any time without prior notice from the Member.
11.4. A person who is not a Member shall have no rights to assert or enforce any provision of these Terms and Conditions.
11.5. The Company may communicate with the Member via Electronic Mail (“email”). By providing an email address to the Company, the Member consents to receive email communications from the Company, including notices in accordance with the Terms and Conditions. The Member also accepts the risk that e-mail is not a secure and confidential means of communication. The Company will not be liable for any loss or damage suffered as a result of communicating with a Member via email.
11.6. Members must at all times adhere to the guidelines of the Studio which may be communicated to them from time to time and are requested to adhere to all reasonable instructions which the management of the Studio may give to ensure the proper functioning of the Studio. guarantees the convenience of all Members.
11.7. Any marketing, educational or other material of this nature produced by the Company in connection with the Studio and made available to Members at the Studio shall at all times remain the property of the Company and shall be subject to the copyright of the Company.
11.8. Only Belgian law applies.
The General Terms and Conditions can change at any time. Members and students will be notified of this by e-mail or in the studio itself. By continuing to use our services, you agree to the changes to these terms and conditions. Read the terms and conditions thoroughly and make sure you understand them. If you do not agree to these terms and conditions, you cannot become a member of Sukoon Studio.
